Adani Challenges High Court Ruling

In 2022, the Himachal Pradesh High Court ordered the state to refund Rs 280 crore to Adani Power. However, a division bench later reversed this decision. The court ruled that Adani Group’s involvement in the project violated the agreement. The judges stated that Adani entered the project through the back door during a pending court case. They decided the premium should not be returned.

Dispute Over Project Premium

The dispute centers on a project originally awarded to Brakel Company in 2007. Brakel obtained the project using fake documents and involved Adani Group without government consent. In 2019, Adani Power filed a petition demanding a refund of Rs 280.06 crore, citing payments made by Brakel for two hydropower projects. The state later canceled the project’s tender, leading to this legal battle.
