While hearing petition Indian Medical Association seeking action against Baba Ramdev and Patanjali Ayurveda for defaming evidence-based medicine, the Supreme Court has expressed displeasure over the claims made in the advertisement issued regarding Patanjali’s medicine.
Justice Ahsanuddin Amanullah said that I have also brought the printout and annexure. We are going to pass very strict orders today. How can you tell that you will fix? Despite our warnings, you are saying that our products are better than chemical based medicines? The bench passed over the matter for the time being. Justice Amanullah said that even after our order you have the courage to bring this advertisement.
Patanjali Vs Indian Medical Association case
Supreme Court earlier issued a directive to Patanjali Ayurved, threatening severe penalties if the company continued to publish deceptive statements and advertisements disparaging contemporary medical systems.
The Indian Medical Association filed a petition against deceptive advertisements, which the bench of Justices Ahsanuddin Amanullah and Prashant Kumar Mishra was deliberating over.
“All such false and misleading advertisements of Patanjali Ayurved have to stop immediately. The court will take any such infraction very seriously, and the court will also consider imposing costs to the extent of Rs 1 crore on every product regarding which a false claim is made that it can ‘cure’ a particular disease,” Justice Amanullah orally said.
The court ordered Patanjali Ayurved to make sure that no insignificant remarks are made to the media and to refrain from publishing any similar ads in the future.
The bench stated that the goal was to actually address the issue of deceptive medical advertising rather than pitting “allopathy against ayurveda.”
The IMA claimed that Patanjali’s July advertisement, which aimed to “promote traditional medicine by disparaging allopathy” and a “continuous, systematic, and unabated spread of misinformation” regarding allopathy, prompted the petition, which was submitted in mid-2022. After giving notice, the court summoned Baba Ramdev last year.
