Neelam Azad, accused of breaching the security of Parliament, got a shock from the Delhi High Court.
The Delhi High Court on Friday stayed the trial court order directing the Delhi Police to supply a copy of the FIR to the accused Neelam Azad in the Parliament security breach case.
Justice Swarn Kanta Sharma delivered the verdict on the petition filed by Delhi Police challenging the trial court’s order.
During the hearing, Delhi Police told the court that the trial court did not follow proper procedure and the FIR contained sensitive details.
Standing Counsel Sanjay Lao for the Delhi Police submitted that the Sessions Judge bypassed the judgment of the Supreme Court holding that in sensitive cases, FIR in UAPA cases is not to be given to the accused.
He further said that there is already a procedure in place that the applicant has to first approach the Commissioner of Police to seek a copy of the UAPA FIR and only after the Committee’s decision can the applicant move the court.
“The execution of the order stands stayed till the next date of hearing. In the meantime, issue notice to the accused for the next date,” the court said.
The Patiala House Court ordered Delhi Police to give Neelam Azad, who is charged with violating Parliament House security, a copy of the FIR.
The judge also ordered an additional 15 days of police custody for Neelam and the co-accused Sagar Sharma, Manoranjan D, and Amol Shinde.
