Aam Aadmi Party MLA Amanatullah Khan has not received any relief from the Delhi High Court in the case against him. The court has refused to stay the ongoing proceedings in the lower court and has summoned the trial court’s records.
The case will next be heard on February 6. Earlier, the Delhi High Court declined to take cognizance of the Enforcement Directorate’s (ED) prosecution complaint seeking to make Khan an accused and release him from custody.
The court cited the Supreme Court’s ruling in the Bibhu Prasad case, which requires prior approval for cognizance. However, the court noted that the issue of sanction could still be resolved.

ED’s counsel, Advocate Zuhaib Hussain, argued that this case differs from the Bibhu Prasad ruling as it pertains to disproportionate assets, not money laundering.
During the hearing, Justice Manoj Kumar Ohri asked about the implications of rejecting a cognizance order. Hussain responded that the trial court had not sought arguments on sanction but still focused its order on that issue.
Justice Ohri emphasized that the matter of sanction would be debated. Hussain asserted that the sanction obtained in this case was broad enough to cover the ED’s charges.
The case revolves around allegations of disproportionate assets during Khan’s tenure as chairman of the Delhi Waqf Board. The legal battle continues, with significant focus on the validity of the sanction.
