The Allahabad High Court on power supply
The Allahabad High Court had made it clear that the National or State Minorities Commission has no right to use the powers of the court. The High Court clearly said that the authority of the Commission is limited to protecting the interests of minorities.
The division bench of Mr Justice MC Tripathi and Justice Prashant Kumar, passed the order on the petition of Divine Faith Fellowship Church of Sambhal and others.
The High Court said that the National and State Minority Commission does not have the right to issue an order to evict thepartner of the tenant of the church shop by declaring him a trespasser and a land mafia and to register an FIR. The Commission also does not have the right to use the powers of the court to summon officials and order eviction of illegal encroachment. The Court rejected the petition
The court said that the authority of the commission is limited for protecting the interests of minorities. The court advised the petitioner to approach the civil court for eviction as per rules.
