The Allahabad High Court on Wednesday said that no crime victim can be denied for arms license on the ground that the incident which happened was accidental. Accepting the petition of the petitioner demanding arms license, the court canceled the order of Ghazipur DM and ordered to consider the petitioner’s representation as fresh.
The above said order was passed by Mr Justice Saurabh Srivastava ,on the petition of Alok Kumar Singh of Ghazipur.
According to the petition the petitioner is a businessman and often travels to many districts in connection with his business. On September 27, 2014, a motorcycle rider assaulted the petitioner and looted Rs 1 lakh. The petitioner had lodged an FIR regarding this matter in the Kotwali police station of Ghazipur. The petitioner demanded an arms license regarding the incident that happened against him. In view of the incident, the police recommended issuing arms license to the petitioner and sent the file to the DM, but the DM refused to grant the arms license saying that the incident with the petitioner was accidental.
On this basis, arms license cannot be issued to the petitioner. The petitioner challenged the DM’s order in the Allahabad High Court and demanded that he be issued an arms license. Petitioner’s advocate Pankaj Tyagi, Akash Tyagi argued that the petitioner does transport business and has to go to banks with money. Because of this there remains a threat to life and property. Accepting the arguments of the petitioner, the court passed an order to DM Ghazipur to consider the petitioner’s representation afresh.
