Delhi High Court Confirms No Stay On Sharjeel Imam’s Trial For Sedition And Hate Speech

The court emphasized that if the trial court finds sufficient evidence, it can frame charges against Imam. The hearing addressed Imam’s plea to quash the sedition and hate speech charges under sections 124A and 153A of the Indian Penal Code

Sharjeel Imam’s Bail Plea

The Delhi High Court has clarified that there is no stay on the trial against Sharjeel Imam, who faces charges of sedition and hate speech for allegedly making inflammatory speeches at Jamia Millia Islamia. Justice Manoj Kumar Ohri stated that the trial court is free to proceed with framing charges against Imam.

Trial Court Can Proceed with Charges

The court emphasized that if the trial court finds sufficient evidence, it can frame charges against Imam. The hearing addressed Imam’s plea to quash the sedition and hate speech charges under sections 124A and 153A of the Indian Penal Code. The court noted that the trial must move forward without delay.

Court Questions Prosecution’s Absences

During the hearing, the court adjourned the matter due to the special public prosecutor’s absence. Despite questioning the prosecutor’s frequent non-attendance, the court accepted the adjournment request. Imam’s counsel reminded the court that the trial court was preparing to frame charges. In response, the court confirmed that there are no barriers to the trial proceeding.
