The Delhi High Court rebuked the Delhi Commission for Protection of Child Rights (DCPCR) on Friday for initiating legal action against the LG based on a press release that was never issued by the LG’s Office. Justice Subramonium Prasad criticized the DCPCR, stating that their actions were irresponsible and lacked seriousness, particularly when making allegations against a constitutional functionary.
Justice Prasad questioned the source of the alleged press release, which was not available in the public domain. The court noted that an affidavit filed on January 23, 2024, confirmed that no such press release had been issued. Additionally, it was highlighted that the petitioner, Ranjana Prasad, was no longer associated with the DCPCR.
The court directed the filing of an affidavit by an officer from the DCPCR within ten days. The matter is scheduled for further hearing on February 29.
The LG of Delhi submitted an affidavit to the Delhi High Court, asserting that no order was issued to halt funding for the DCPCR. This affidavit was filed pursuant to Justice Subramonium Prasad’s order on January 19, 2024. The LG’s affidavit emphasized that no press release was issued or signed by the LG or his secretariat on November 9, 2023, as claimed by the petitioner.
The Delhi High Court is overseeing a petition alleging that the LG ceased funding for the DCPCR. This case was transferred from the Supreme Court to the Delhi High Court. The LG’s counsel stated that no such order was issued and refuted the existence of the asserted press release. Furthermore, it was noted that the petitioner’s commission currently has an excess of funds exceeding 5 crores.

The court expressed concern over the potential political implications of the petition and instructed the counsel to submit the facts stated in court in an affidavit.
Previously, the petitioner commission approached the Supreme Court on December 15, 2023, alleging that its funds were frozen by the LG. However, the Supreme Court directed the case to be transferred to the Delhi High Court.
