A Delhi court acquitted three women accused of drug possession, citing insufficient evidence in the case. Additional Sessions Judge Ekta Gaba stated that no narcotic substance was found in the samples recovered from the accused, Anju, Lalita, and Monica. Each was initially charged after police claimed to have seized 12 grams of smack from them on May 4, 2017, near Delhi Gate metro station.
Judge Gaba highlighted flaws in the investigation, including the absence of an independent witness during the recovery and the lack of CCTV footage from the area. Referring to the forensic report, the judge noted that the evidence presented contained no narcotic substance or tranquilizer, making the Narcotic Drugs and Psychotropic Substances (NDPS) Act inapplicable.
The judge underscored that the recovery quantity was just above a small amount, which further affected the case’s strength. The lack of evidence ultimately undermined the credibility of the prosecution, which failed to prove its case beyond a reasonable doubt.
