The court has rejected the plea of former Aam Aadmi Party (AAP) councillor Tahir Hussain, who sought documents related to the conspiracy behind the 2020 North East Delhi riots. Hussain and several others are facing charges under the Unlawful Activities Prevention Act (UAPA).
Additional Sessions Judge Sameer Vajpayee of Karkardooma Court noted that Hussain had requested the statement of eyewitness Rahul Kasana in his application. Kasana had provided this statement in a separate case involving riots and money laundering against the former AAP councillor. The judge also considered the argument by Special Public Prosecutor Amit Prasad, who claimed that Hussain’s application was an attempt to gather documents for his defense, even though charges have not yet been framed at this stage.

The court emphasized that the hearing is still in its initial phase and charges have not been framed. Therefore, providing the requested statement at this stage cannot be considered. Additionally, the application did not clarify how the statement would assist Hussain’s case. After reviewing all the facts, the court concluded that there was no merit in the application at this stage and consequently dismissed it.
