Court Delays Final Order On Framing Of Charges In Delhi Riots Case

The Karkardooma Court has delayed its decision on framing charges in the 2020 Delhi Riots case until September 23. The High Court issued this order after hearing a petition by riot accused Devangana Kalita. She requested access to videos and WhatsApp chats in two cases.

One case involves the Unlawful Activities (Prevention) Act (UAPA) and relates to the violence during the 2020 protests against the CAA and NRC.

Police Request Adjournment, Kalita’s Counsel Objects

The Delhi Police lawyer, appearing via video conference, requested an adjournment, citing lack of the case file. Kalita’s counsel opposed, stating the petition relates to uncertified documents under Section 207 of the CrPC.

Justice Neena Bansal Krishna allowed the trial court to debate the charges but ordered no final decision until September 23.

Kalita Seeks Evidence for Defense

Kalita’s counsel argued that she needs the videos to prove her innocence, accusing the prosecution of withholding supportive evidence. The police opposed this, claiming the petitions were not maintainable.

Kalita, along with other activists like Sharjeel Imam and Umar Khalid, faces charges related to the riots, which left 53 people dead and over 700 injured. The court will resume hearing on September 23.
