The bail plea of Nikita Singhania, wife of Atul Subhash, will be heard in court on January 4. Atul, an automobile company employee, committed suicide after his wife allegedly demanded Rs 3 crore for a divorce settlement.
Akash Jindal, the family’s lawyer, argued that Nikita should not use the child to secure bail. He stated that the family had filed a habeas corpus petition with the Supreme Court to find the child and seek custody.
Jindal emphasized that the crime committed was serious and that the child’s safety should be prioritized. He questioned why the 4-year-old child was in a hostel instead of with his mother. The family has requested full custody to ensure the child’s well-being.
Pavan Kumar Modi, Atul’s father, voiced concerns that Nikita might harm the child if granted bail. He said, “If she could drive my son to suicide, she could harm the child as well.” Modi further accused Nikita of treating the child like an “ATM” to secure money.
Bikas Kumar, Atul’s brother, expressed confidence in the police investigation. He confirmed that the matter is before the Supreme Court, with a hearing set for January 7.
Following Atul’s suicide, police arrested Nikita, her mother, and brother. They face charges under Sections 108 and 3(5) of the Bharatiya Nyay Sanhita. The family claims the accused demanded Rs 3 crore from Atul, leading to his harassment and death.
Nikita’s family, on the other hand, alleged that Atul had demanded a large dowry, which contributed to the death of her father. Atul’s suicide, marked by a 90-minute video and a 40-page note, has led to ongoing investigations into the circumstances surrounding his death.
