Italy Accuses OpenAI Of Violating EU Data Protection Laws

OpenAI may submit its counterclaims concerning the alleged breaches within 30 days

Italian authorities have accused OpenAI, the creator of ChatGPT, of violating EU data protection laws, giving the US company 30 days to answer.

In a statement, Italy’s data protection watchdog has notified breaches of data protection laws to OpenAI, the company behind ChatGPT’s artificial intelligence platform.

Last year, the watchdog barred a popular chatbot for several weeks, making it the first Western country to do so.

“Following the temporary ban, the watchdog concluded that the available evidence pointed to the existence of breaches of the provisions contained in the EU GDPR, the European Union’s general data protection regulation”, the statement reads.

“OpenAI may submit its counterclaims concerning the alleged breaches within 30 days”, the statement continued.

The watchdog stated that in making a final decision in the case, it would take account of the work in progress by a task force set up by the EU’s central data regulator to assist countries deal with issues regarding ChatGPT.

Last year, the Italian watchdog stated that OpenAI lacked a legal basis to justify the mass collection and storage of personal data to develop the algorithms that power ChatGPT.

It also revealed a lack of clarity on whose data was being collected.
