The Allahabad High Court has directed the school to form an internal complaint committee and conduct an investigation into the case of a teacher doing unethical acts with a female peon appointed as a dependent of the deceased.
Passing the above said order Mr. Justice Vikas Budhwar directed that constituted committee should submit its report to the competent authority within two months. After this, the District Panchayat Council President should take action as per rules.
The council for the petitioner Alok Kumar Yadav, pleaded that the female peon was appointed in the year 1993 in District Panchayat Girls Inter College, Village Ugrasenpur ,Prayagraj as a dependent of the deceased.
The teacher, who came after being transferred from Agra in 2014, used dirty gestures and words and also attempted to physically abuse her.
There is no internal inquiry committee constituted in this school under the Protection of Women from Sexual Harassment Act 2013 and due to this, despite many complaints, no action was taken against the accused teacher.
He further said that that opposition may create more problems for her by being angry with the action, the court said that the woman will have the right to file an application to the competent authority under Section 12 of the said Act. .
District Panchayat Girls Inter College Ugrasenpur Prayagraj provides education to children till 12th. The school is recognized by UP Board.
It was also accepted by the government and the District Panchayat that no internal complaint committee has been constituted in the college under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Prevention Act 2013).
An FIR has also been registered in Phulpur, Prayagraj police station regarding the incident. The woman has been filing her complaint repeatedly since August 2022, but no action has been taken. He was forced to approach the court.
