The Allahabad High Court directed the Ghaziabad Marriage Registration Officer to appear personally before the court.
The officer must also produce all relevant records concerning the registration of a minor girl’s marriage. A single bench of Justice Tej Pratap Tiwari passed the order.
The court issued the order while hearing a criminal appeal filed by Ashish alias Nitish Verma.
During arguments on the appellant’s application seeking suspension of his sentence, his counsel referred to the marriage registration certificate.
According to the certificate, the appellant registered his marriage with the victim on February 4, 2019.
However, the trial court had determined the victim’s age as 16 years and 11 months on the date of the incident.
The High Court observed that these circumstances indicated that the marriage registration authority appeared to have registered the marriage of a minor girl with the appellant.
The court directed the concerned officer to appear personally and produce all records on the basis of which the authority verified the victim’s age and registered the marriage.
The court also directed that a copy of the order be sent immediately to the Ghaziabad District Magistrate.
The District Magistrate was asked to ensure that the concerned officer appears personally before the court.
The officer will have to explain how he registered the marriage of a girl whom the trial court had declared a minor.
The court directed that a copy of the order be sent immediately to the Registrar (Compliance) of the High Court.
This was to ensure compliance with the court’s directions. The court will hear the matter next on October 9, 2026.
