The Delhi High Court has instructed the National Highways Authority of India (NHAI) to review a complaint concerning alleged unfair toll collection and the improper setup of toll plazas across the country.
Petition Seeks Compliance with Toll Collection Rules
A bench led by Chief Justice Manmohan and Justice Tushar Rao Gedela issued this directive while disposing of a Public Interest Litigation (PIL) filed by Anand Mishra. The petitioner argued that under the National Highway Fee (Determination of Rates and Collection) Rules, tolls should not be collected on incomplete sections of highways, and toll plazas must be at least 60 km apart.
Mishra requested the NHAI to follow these rules nationwide and refund any tolls collected in violation.
NHAI Given Four Weeks to Act
The court has allowed Mishra to submit a detailed representation to the NHAI within two weeks. The NHAI must respond within four weeks, as per the court’s order. Mishra had previously raised the issue with authorities in August, but no action was taken.
