On Tuesday, the Supreme Court declined to stay the Allahabad High Court’s decision on the Krishna Janmabhoomi-Shahi Eidgah Masjid dispute. The High Court had upheld the civil suits filed by Hindu worshippers.
Special Leave Petition Review Scheduled
A bench led by Justice Sanjiv Khanna issued a notice to review the special leave petition from the Shahi Masjid Idgah’s Management Committee. The petition challenges the dismissal of their application under Order VII Rule 11 of the CPC. Justice Khanna and Justice Sanjay Kumar set a hearing for the week of November 4, alongside other related petitions.
Allahabad HC Proceedings to Continue
The Supreme Court clarified that the special leave petition does not stop the Allahabad High Court from proceeding with the suits. The High Court had rejected the mosque committee’s claim that the suits were barred by various statutes. Justice Mayank Kumar Jain ruled that the suits involve complex issues of fact and law, requiring detailed examination.
The suits seek to declare the land as belonging to Lord Krishna and request the removal of the mosque’s construction. The Supreme Court is also reviewing a plea from the mosque committee challenging the High Court’s decision to transfer the suits to itself.
