The Allahabad High Court has stayed any oppressive action against Mohammad Zaki, the brother of Mo Farid, who was killed in a mob lynching in Aligarh. This stay will continue until the next hearing or until a charge sheet is filed under the FIR registered against Zaki.
The court has issued a notice to the state government and the complainant, asking for a response within three weeks. The division bench of Justice Siddharth Verma and Justice Ram Manohar Narayan Mishra passed the order on Zaki’s petition.
FIR Challenged by Zaki
Zaki’s petition challenges the FIR filed against him on June 29, 2024, at Gandhi Park Police Station, Aligarh. The FIR alleges offenses under Sections 395 and 354 of the IPC. Zaki’s advocate, Tanisha Jahangir Munir, argued that the FIR was filed as retaliation after the mob lynching of Zaki’s brother on June 18, 2024. An FIR had already been filed regarding the lynching, and the complainant’s husband, involved in that incident, had been arrested.
Court Seeks Explanation from Opponents
The petition argues that the June 29 FIR does not mention the mob lynching or the post-mortem report. Instead, it falsely claims that the complainant’s husband is at home, despite his arrest. The court found the matter debatable and has sought explanations from the state government and other respondents. The case will be heard again in five weeks.
