High Court: Leaving Husband Without Reason Is Cruelty, Like Death Of Soul In Hindu marriage

In one of its decisions, the Allahabad High Court has made important comments about the relationship between husband and wife and Hindu marriage customs. The court said, in a Hindu marriage, leaving a spouse without any valid reason is cruelty towards the spouse left alone.

Prayagraj: In one of its decisions, the Allahabad High Court has made important comments about the relationship between husband and wife and Hindu marriage customs. The court said, in a Hindu marriage, leaving a spouse without any valid reason is cruelty towards the spouse left alone. It is like the death of the soul of Hindu marriage.

These things have been said by the bench of Justice Saumitra Dayal Singh and Justice Donadi Ramesh.Abhilasha Shrotri was married to Rajendra Prasad Shrotri in 1989. They had a child in 1991. Both the parties separated after a few years of marriage. However, after some time they started living together again. After that they separated again in 1999.

According to the second agreement, both the parties started living together again. However, they finally separated in 2001 and have been living separately since then. The wife approached the High Court against the divorce granted by the Judge Family Court Jhansi.

The court found that the marital relationship between the parties was bad, as both the parties had made several allegations against each other. These included the allegation of cruelty by the husband against the wife. It was alleged that the wife’s cruel behavior led to her mother committing suicide. The court found that both the parties had separated after mutual agreement and were living separately for 23 years.

It was further held that , “In cases of long-standing soured relations, there is no scope for revival of their marital relationship.” The court held that the appellant-wife never wanted to have a relationship with the husband. She did not want to revive her marital relationship with the husband. The wife’s conduct was the same for the last 23 years without any reason. Therefore, the court upheld the divorce decree and ordered to pay Rs 5 lakh as permanent alimony to the wife.
