Subramanian Swamy Files PIL In Delhi HC Seeking Cancellation Of Rahul Gandhi’s Citizenship

New Delhi, Aug 16: Senior BJP leader Subramanian Swamy has asked the Delhi High Court to direct the Union Home Ministry to cancel Rahul Gandhi’s Indian citizenship. Swamy claims the Congress leader “declared himself as a British citizen.”

On Friday, Swamy posted on X, stating he filed a public interest litigation (PIL) against the Centre’s failure to prosecute Rahul Gandhi. He demands a show-cause notice to explain why Gandhi should not lose his Indian citizenship.

The plea seeks a status report on Swamy’s complaint against Gandhi and urges a swift decision.

In 2019, Swamy wrote to the Home Ministry, accusing Gandhi of violating rules by declaring British citizenship to the UK government and holding a British passport.

Swamy argues that by this declaration, Gandhi forfeited Indian citizenship under Article 9 of the Constitution and the Indian Citizenship Act, 1955.

Swamy points to a company named Backops Limited, registered in the UK in 2003. Gandhi served as a Director and Secretary. In the company’s 2005 and 2006 filings, Gandhi listed his nationality as British. The dissolution application in 2009 also described his nationality as British.

Swamy’s petition mentions repeated requests to the Home Ministry for updates on his complaint. He claims no action or response has been received.

The petition asks the court to direct the Home Ministry to submit a status report on his complaint against Gandhi and to decide on it promptly.
