The Delhi High Court has directed the central government to clarify its position on the petition seeking the cancellation of Congress MP Rahul Gandhi's Indian citizenship.

These words were added during the 42nd Amendment in 1976, under the tenure of Prime Minister Indira Gandhi. Petitioners Balram Singh, Subramanian Swamy, and Ashwini Kumar Upadhyay have termed the addition unconstitutional and demanded its removal

According to the court's causelist, a bench led by Chief Justice Manmohan will address the matter. In a previous hearing, the bench noted that a similar petition is pending before the Allahabad HC. The bench instructed the Union government’s standing counsel to obtain a copy of that petition and its status
