Rejecting the bail Plea of Manish Sisodia on Tuesday, the Delhi High Court said that the trial is being delayed because of the accused, not the Enforcement Directorate.
A bench of Delhi HC had reserved the decision on May 14 after hearing the arguments from both the parties.
Manish Sisodia had sought bail on the basis of delay in both CBI and ED cases.
The court upheld the lower court’s decision to allow Sisodia to meet his ailing wife once a week.
The former Deputy Chief Minister of Delhi is lodged in Tihar jail in connection to the Delhi liquor policy scam.
Hearing Sisodia’s Plea, the High Court said that Sisodia was Deputy Chief Minister of the territory. The court further acknowledged that the opinion sought from the public for making the liquor policy was influenced by the intention of benefitting some people.
The bench of Justice Swarnakanta Sharma of Delhi High Court maintained that Sisodia himself sent fake emails with the help of Zakir to obtain desired feedback from the people
During the hearing of the case, lawyer Zoheb, appearing on the behalf of The ED said that the accused is causing delay to the case.
While, demanding bail for Manish Sisodia, his lawyer said there has been negligible work done in the starting of the trial. Arrests are still being made. Sisodia’s lawyer further said that investigation is still going on in the matter, this has not been taken into consideration hence Sisodia should be granted bail as per the Supreme Courts decision.
Notably, Delhi’s Rouse Avenue Court had rejected the bail plea in this regard on April 30. Later Sisodia filed plea in Delhi High Court demanding bail on the behalf of the reasons mentioned above.
Delhi’s new liquor policy was announced by Manish Sisodia on March 22, 2021. The liquor police named Excise Policy 2021-22 was implemented in November 2021.
Later on July 28, 2022 Excise Policy was Scrapped as it attracted controversies owing to the loopholes in its formulation.
