A case of eviction of flats from unmarried tenants has come to light in A Housing Society located in Dwarka. The High Court has directed Delhi Police to submit a report on a petition filed against attempts to force unmarried tenants to vacate their flats.
Court asked for a report from the police
Justice Mini Pushkarna has granted the police four weeks to file a status report in a case scheduled for hearing on March 13. The issue revolves around a notice by the Bairava Bharati Managing Committee in July 2022, urging graduate tenants and commercial offices in a Dwarka housing society to vacate their premises.
Society had prohibited
In August 2022, the district court had temporarily halted the notice. Subsequently, Home Residency Infratech Pvt Ltd, a private company owning a flat in the society, filed a contempt of court case in the Delhi High Court, claiming a violation of the district court order. The court was informed that despite the district court’s stay order, discrimination against bachelors and commercial offices persisted.
The petitioner provided details to the court
The petitioner informed the court that on January 4, the management committee, along with security guards, prevented bachelor tenants from entering the society. A female bachelor tenant from the North East is also facing harassment for not knowing Hindi, underscoring the discriminatory atmosphere.
Despite the High Court’s directive on August 11, 2023, to ensure compliance with the stay order and prevent unnecessary harassment of bachelor tenants, the court was now informed that management members had halted tenants on various occasions.
Petitioner’s lawyer, Samriddhi Arora, argued that the society management’s conduct is indirectly fostering a discriminatory environment, creatively pushing bachelors to vacate the society flats. The court was informed of the discriminatory treatment, including the requirement for bachelor tenants to sign a register multiple times a day upon entering the society—a requirement not imposed on other residents.
The petitioner requested the preservation of CCTV footage of Classic Apartments, Bairwa Bharti CGHS Ltd., particularly regarding the January 4 incident where the managing committee allegedly barred bachelor tenants from entering the society around noon.
