ALLAHABAD HIGH COURT
PRAYAGRAJ: The Allahabad High Court has cancelled the order of Tehsildar to demolish Radha Swami Satsang Bhawan located in Dayalbagh, Agar.
The above said order was passed by Mr. Justice Manish Kumar Nigam on the petition of Radha Swami Satsang Sabha. After hearing the case, the court had reserved its decision on October 16.
The council for the petitioner pleaded that the petitioner was not given an opportunity of hearing while 15 days time was sought to reply to the notice, but he was given the opportunity to file the reply till 4 pm on September 24. It was also said that the Tehsildar did not consider the objections of the petitioner while passing the order.
It was said by the state government that there has been encroachment on government land. For this reason action was taken.The land which the administration is forcibly vacating is in the name of Satsang Sabha.
The administration not only arbitrarily used bulldozers but also lathi-charged the satsangis. Copies of all the agreements, lease deeds and orders made from 1935 to 2012 were attached with the petition. Along with this, the reply to the Tehsildar’s notice dated 19 September 2023 and the revenue records of the concerned plots were also attached in the petition.
Apart from Khasra Khatauni, other revenue records and answers of more than two dozen pages, photographs of the fight with the police were also put up by the government.
It is noteworthy that violence took place during the eviction of land in Dayalbagh of Agra. There was stone pelting by the devotees while the police resorted to lathi charge. About 50 devotees were injured in the lathi charge. Many policemen were also injured in stone pelting.
