The Supreme Court has rejected a petition seeking to stop the Bharatiya Janata Party (BJP) from using the lotus as its election symbol. The court reprimanded the petitioner, Jayant Vipat, for filing the case, saying the demand seemed aimed at gaining fame. The bench, consisting of Justice Vikram Nath and Justice PB Barale, dismissed the case after a brief hearing.
Previous Petitions Also Rejected
Vipat had previously filed petitions in both the trial court and the Madhya Pradesh High Court, which were dismissed. He argued that as the lotus is the national flower, it should not be used as a party symbol. He also claimed that BJP does not deserve benefits under the Representation of the People Act, 1951. Both the lower courts and the Supreme Court dismissed his claims.
Similar Petition Dismissed by Madras High Court
In 2023, the Madras High Court also rejected a similar petition filed by T Ramesh. He sought to stop BJP from using the lotus symbol, arguing it should not be associated with a political party. The court found no merit in the argument, as the election symbol had already been legally allocated.
