Patna High Court: 12th pass candidates will also be able to become Amin in Bihar, after the HC order

Bihar: The Patna High Court heard on Tuesday the application filed by the state government challenging the order to cancel the advertisement of Amin reinstatement and publish the advertisement afresh. The court quashed the decision of the former single bench.

Patna High Court: The Patna High Court has cleared the way for the reinstatement of Amins. Justice Ashutosh Kumar’s bench made it clear in its decision that 12th class pass candidates can also become Amin now, because according to the amendment made by the state government in the year 2016-17 for the restoration of Amins, 12th pass candidates can also become Amins. Considered eligible for the post. The court (Patna High Court) has heard the appeal filed by the state government regarding this matter and the intervention petition filed by the selected candidates, who were not appointed to this post even after selection. But, the court heard.

The court (Patna High Court) said that the single bench had directed the appointment of Amanat degree holders to the post of Amin as per the rules of the year 2013. The court said that the single bench was not informed about the amendment made by the state government in the year 2016-17 for the appointment to this post. Because of which the court did not consider 12th pass candidates eligible for appointment to the post of Amin.

The High Court Orders

Earlier, the Single Bench of Justice PB Bajanthari had quashed the advertisement issued by the Revenue Department of the State Government in January, 2020 for the reinstatement of 1767 vacant posts of Amin in the State. The court had directed the state government to start the process of recruitment by publishing a fresh advertisement in three months for the restoration of 1767 vacant posts of Amins. Justice PB Bajanthri gave this direction while hearing several writ petitions filed by petitioner Ram Babu Azad and others.

On behalf of the petitioner, the court was told that the qualification published by the state government in the advertisement for the educational qualification for the reinstatement to the post of Amin was not in accordance with the provisions. As per the Bihar Amin Cadre Rule, the candidate must have passed 10+2 with Amanat’s degree or ITI in Surveyor’s degree. According to the educational qualification that was kept in the advertisement issued by the Revenue Department of the State Government, it was sufficient for the candidate to pass only 10+2.

Regarding this matter, the candidates for the degree of Amin challenged this advertisement published by the state government by filing a writ in the Patna High Court. After listening to all the parties, the court canceled this advertisement and directed the state government to make a fresh advertisement and make an appointment. It has become clear from the order given by the High Court bench for the reinstatement of Amin that not only Amanat degree holders, but also 12th pass candidates will be considered eligible for appointment to this post.
