On April 3, the Supreme Court will hear the Central Bureau of Investigation’s (CBI) appeal challenging the Allahabad High Court’s acquittal of Surendra Koli, the main accused in the chilling Nithari murder case.
The Allahabad High Court had overturned the death sentences of Koli and his accomplice, Moninder Singh Pandher, due to insufficient evidence, sparking widespread controversy.
The Nithari Murders
The Nithari case, which took place between 2005 and 2006 in Noida, involved the horrific abduction, rape, and murder of numerous women and children.
The police discovered the victims’ remains in a drain behind Pandher’s house in Nithari village, triggering one of India’s most gruesome criminal investigations.
Surendra Koli, an employee of Moninder Singh Pandher, allegedly carried out the murders, with Pandher believed to be complicit in the crimes.
In 2017, the trial court had sentenced Koli to death for the murders of several victims, including minors.
The court also awarded the death penalty to Pandher for his role in the crimes.
However, in 2021, the Allahabad High Court overturned these sentences, stating that the prosecution had failed to prove the charges beyond a reasonable doubt, primarily relying on circumstantial evidence and forensic analysis.
CBI’s Appeal To The Supreme Court
The CBI, which took over the investigation in the Nithari case, has now approached the Supreme Court, emphasizing the severity of the crimes committed.
The CBI’s Solicitor General, Tushar Mehta, argued that the murders were committed in a manner that left no doubt about the accused’s involvement, asserting that justice should be served for the victims and their families.
The case has raised several questions about the adequacy of circumstantial evidence in securing convictions, and the legal scrutiny of the acquittal has garnered attention nationwide.
The CBI has sought the Supreme Court’s intervention to restore the death sentence of the accused and ensure justice for the victims.
