Supreme Court Declines Plea For Probe Into Uttam Nagar Killing

The Supreme Court on Wednesday declined to hear a petition seeking a court-supervised probe into the killing of a man during Holi festivities in Delhi’s Uttam Nagar.

A Bench led by Surya Kant stated that the petitioner should initially seek relief from the police, including measures for the victim’s family’s safety.

The Bench, which also included Joymalya Bagchi and Vipul M Pancholi, emphasised that the Delhi Police is a competent force and cautioned against discrediting it. It permitted the petitioner to submit a comprehensive representation to the Police Commissioner, who would evaluate any threats and take suitable action.

The court added that the petitioner could approach the Delhi High Court if concerns remain unresolved.

The petition described the death of 26-year-old Tarun Kumar as an instance of mob lynching. It requested a court-monitored investigation, security arrangements for the bereaved family, and compensation amounting to ₹5 crore.

It also referenced the landmark Tehseen Poonawalla case, which outlines preventive and remedial steps against mob violence.

Police reports indicate that unrest broke out in Uttam Nagar during Holi after a minor disagreement involving a water balloon escalated into a clash between two groups.

The situation intensified as more people gathered at the spot.

Tarun Kumar, who was heading home after celebrations, was allegedly stopped near his residence and brutally assaulted using rods, sticks, bricks and stones. He later succumbed to severe head injuries at a hospital.

NHRC Takes Cognisance

The National Human Rights Commission has taken note of the incident and issued notices to the West Delhi District Magistrate as well as the Commissioner of Police.

The Commission observed that the claims, if substantiated, point to a prima facie violation of human rights.

The NHRC has instructed authorities to carry out an impartial investigation, bring all accused individuals to justice, and assess potential risks to the victim’s family. It has further directed officials to secure all relevant evidence, including CCTV recordings, digital material, and forensic samples, and submit an Action Taken Report within a fortnight.

The matter remains under scrutiny as investigations continue into the fatal episode.
