SC To Hear Lokpal’s Jurisdiction Over Judge Complaints

The Supreme Court of India on April 15, 2025, will hear an important case regarding the jurisdiction of the Lokpal in considering complaints against sitting judges.

The Court, led by Justices BR Gavai, Suryakant, and Abhay S Oka, appointed senior advocate Ranjit Kumar as an amicus curiae to assist in the matter.

The case arises from complaints filed against a sitting High Court judge, raising significant questions regarding the application of Lokpal laws to judicial officers.

The Case’s Background

The complaint in question involves allegations of corruption against a sitting High Court judge.

The Lokpal had decided to proceed with the complaint and initiate an investigation.

However, the matter is contentious as there is a debate on whether complaints against sitting judges fall under the jurisdiction of the Lokpal or not.

The Solicitor General of India, Tushar Mehta, argued that complaints against High Court judges are beyond Lokpal’s jurisdiction.

He stressed that Lokpal’s mandate covers only specific sections of the law, and complaints involving judges’ constitutional duties should not be entertained.

The argument presented by Mehta raises questions about whether judicial officers, as public servants, are subject to Lokpal’s investigations or whether they are immune due to their constitutional status.

Legal Opinions & Considerations

Senior advocate Kapil Sibal, representing the complainant, argued that this issue is of fundamental importance.

He questioned whether anyone could register complaints outside the constitutional framework, particularly against those holding constitutional office.

The Court raised concerns about the independence of the judiciary and its possible interference by external bodies like Lokpal.

Justice Gavai made it clear that the Court would consider only the jurisdictional issue under the Lokpal Act, leaving aside broader constitutional concerns for the time being.

The Court’s focus will be on whether the Lokpal has the power to investigate complaints against sitting judges as part of its mandate under the law.

Implications For Judicial Oversight

This case marks a significant moment in the ongoing discussions about accountability and transparency in the judiciary.

While the Lokpal Act was created to address corruption in public offices, this case opens a new door regarding its applicability to judicial officers.

If the Court decides that Lokpal has jurisdiction over judges, it could pave the way for increased scrutiny and accountability within the judiciary, which has long remained beyond the reach of external oversight.

Many are awaiting the outcome of this case, as it will set a precedent for the extent of judicial accountability in India, particularly regarding corruption allegations against judges.

As the Supreme Court prepares to hear this case, it is crucial to understand the implications of judicial independence and the scope of Lokpal’s powers.

The decision could reshape how courts handle corruption complaints against judges, balancing judicial independence with accountability to the public.
