The Enforcement Directorate (ED) has filed a revision petition in the Delhi High Court against the Rouse Avenue Court’s decision to release AAP MLA Amanatullah Khan. The court had refused to take cognizance of the ED’s prosecution complaint, which accused Khan in a disproportionate assets case.
Special counsel Zoheb Hussain, representing the ED, argued that the trial court found sufficient grounds to proceed against Khan. However, the court dismissed the case due to the lack of approval. Hussain referred to the Supreme Court’s ruling in the Bibhu Prasad case, claiming the issue of approval could be resolved. He noted that this case deals with disproportionate assets, not money laundering.
ED Questions Court’s Decision on Approval
Justice Manoj Kumar Ohri questioned the consequences of rejecting a cognizance order. Hussain explained that no hearing could take place after the rejection. He also pointed out that the trial court did not allow arguments on the sanction issue, but based the entire order on it. Justice Ohri stated that the sanction issue would be discussed, and the ED should present its stance.
Hussain argued that the sanction received by the ED is broad enough to include the case. The court has directed the ED to submit the trial court’s order sheet and set the next hearing for January 13.
Debate Over Sanction to Proceed
The case now centers on whether the sanction received by the ED is valid for the disproportionate assets charges. The court will review this issue at the next hearing.
