Delhi High Court Orders MCD To Investigate Encroachment On School Land In Wazirpur

The Delhi High Court has directed the Delhi MCD to investigate whether there is any encroachment on the land of a school.

The Delhi High Court has directed the Municipal Corporation of Delhi (MCD) to investigate whether there is any encroachment on the land of a school in Wazirpur.

The NGO Save India Foundation filed the petition, alleging that a tall religious structure, accompanied by several shops, had been built on the school’s land.

Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela instructed the MCD to treat the petition as a formal representation and take appropriate action if they found the encroachment to be true.

The petition claims that this is a ‘shocking encroachment’ and urges for its removal.

Delhi MCD’s Response To Allegations

During the hearing, MCD’s lawyer argued that the religious structure is located in front of the school and suggested that the petitioner should have contacted the religious committee, which deals with the demolition of unauthorized religious structures.

The counsel further claimed that the alleged shops stood in sheds outside the school’s boundary.

However, the bench clarified that the MCD should thoroughly consider the concerns raised in the petition. The court ordered MCD to survey to verify the allegations and prepare a report on the matter.

If authorities find any illegal construction related to the religious structure, they should refer the case to the religious committee for further action.

Court Emphasizes Safety Of Students

The bench also expressed concern over the security of the students at the school, particularly given that a significant number of girls study there.

The court pointed out that there are open pathways leading to the school and highlighted that it is the MCD’s responsibility to ensure the safety of students, especially female students.

The court underscored the need for heightened security at the school and ordered the MCD to take immediate action to ensure the students’ safety.

The MCD will conduct a thorough investigation and report as the case unfolds.
