The Delhi High Court has granted interim relief to human rights activist and APCR National Secretary Nadeem Khan by staying his arrest. Justice Jasmeet Singh’s bench directed Nadeem Khan to cooperate with the investigation and join the probe. The court also instructed him not to leave Delhi without the investigating officer’s permission.
The High Court issued a notice to Delhi Police on Nadeem Khan’s petition seeking the cancellation of the FIR against him. The court remarked during the hearing that the nation’s goodwill is not fragile.
FIR and Allegations Against Nadeem Khan
Right-wing groups had circulated a viral video of an exhibition involving Nadeem Khan. The exhibition highlighted incidents of harassment due to hate crimes and hate speeches.
On November 30, a police team from Delhi’s Shaheen Bagh Police Station attempted to detain Nadeem Khan at his brother’s residence in Bangalore without a warrant or notice. The police reportedly harassed his family during the six-hour operation before leaving a notice under Section 35(3).
Questions Raised Over Police Action
The People’s Union for Civil Liberties questioned the urgency of detaining Khan without proper legal procedures. They criticized the police for bypassing requirements like issuing a warrant or prior notice.
The Nadeem Khan FIR case has sparked debates over police conduct and the rights of activists, with the High Court providing temporary relief as the investigation continues.
