Delhi HC Urges Govt To Resolve Soldier Farm Colony Regularization Issue

Delhi High Court has stepped in to address the ongoing issue of the Soldier Farm Colony’s regularization.

In its recent hearing, the court ordered the central and Delhi governments to come together and find a resolution, emphasizing the need for decisive action.

Court’s Directives For Action

During the proceedings, the bench, led by Chief Justice DK Upadhyay and Justice Tushar Rao Gedela, noted that the matter has been left unresolved for too long.

The judges observed that authorities have neither demolished the colony nor officially recognized it as legal.

The court instructed the authorities to convene a meeting and determine a concrete path forward, as the issue has been dragging for years.

In response to the delays, the court expressed frustration, highlighting that it cannot allow the situation to continue without a resolution.

The court emphasized that it is not dictating specific actions but merely requesting that the authorities make a decision, whether to regularize or not.

The bench made it clear that the procrastination from both the central and Delhi governments must end.

Long Standing Legal Disputes

The case has been ongoing since 2015, with concerns raised in several petitions regarding the status of Soldier Farm Colony, a residential area housing several families.

Despite being a prosperous and populated locality, the colony has struggled with its legal status.

The court had earlier noted the urgent need for attention from the Ministry of Housing and Urban Affairs, the Delhi government, and the Delhi Municipal Corporation.

The legal dispute centers on whether authorities should formalize the colony, which houses thousands of residents, through regularization.

The court has instructed the authorities to take action and stressed the need to decide on the charges for regularization if the colony is legalized.

Previous Developments In The Case

Earlier hearings revealed that in 2017, discussions were ongoing between the Ministry of Urban Development and the Delhi government about the possibility of regularizing the colony.

While the government showed interest, it had not yet taken formal steps to resolve the issue.

As of the latest hearing, the situation remains stagnant, prompting the court to urge a swift resolution to prevent further delays.

The court’s intervention highlights the growing frustration over the lack of progress, especially as families continue to reside in an area with uncertain legal status.

It now rests on the government to finalize its stance on the future of Soldier Farm Colony, and the court has clearly set the expectation for a concrete, policy-driven solution.
