Delhi HC Seeks Responses On Kejriwal Recusal Plea In Excise Policy Case

The Delhi High Court on Monday issued notice on a recusal plea filed by Arvind Kejriwal, who appeared in person and sought that proceedings in the excise policy case be heard by a Bench other than that of Justice Swarana Kanta Sharma.

The development came during the hearing of a petition by the Central Bureau of Investigation challenging a trial court order that discharged Kejriwal, former Deputy Chief Minister Manish Sisodia, and other accused in the alleged corruption case linked to the now-scrapped Delhi Excise Policy 2021–22.

At the outset, Kejriwal informed the court that he had filed an application seeking Justice Sharma’s recusal and requested it be taken on record. Appearing personally, he stated his intention to argue the matter himself.

Solicitor General Tushar Mehta, representing the CBI, opposed the plea, describing the allegations as baseless, frivolous, vexatious and contemptuous.

He argued that while Kejriwal could appear in person, he could not alternate between personal appearances and legal representation, and stressed that most respondents had yet to file replies despite earlier directions. He also indicated that rejection of such pleas could warrant contempt proceedings.

Court Issues Notice, Lists Matter For April 13

Responding to objections, Kejriwal said procedural rules required court permission to formally file his application and reiterated his intent to argue the case himself.

Taking note, Justice Sharma directed the issuance of notice and sought replies. The court also allowed other parties to file similar recusal applications, stating they would be decided together. Written submissions were directed to be placed on record, and the matter was listed for April 13 at 2:30 pm.

The High Court is hearing multiple connected matters arising from a February 27 trial court order that discharged all accused, citing a lack of evidence of a larger conspiracy.

The CBI has challenged the order, while the Enforcement Directorate has sought the removal of adverse observations against it. Separately, Kejriwal has moved the Supreme Court challenging the refusal to transfer the case from Justice Sharma’s Bench.
