The Civil Judge of Dwarka Court, Nishant Bangar, has issued a show cause notice to the sub-registrar of Kapashera for not complying with a court order to register land inherited by two siblings.
Despite explicit instructions, the sub-registrar failed to act on the release deed submitted by the heirs, prompting the court to seek an explanation.
The case revolves around SP Swami, the owner of a property in Deenpur village, Najafgarh, who presented a release deed to the sub-registrar to transfer his land to his children, daughter Vidya Lakshmi and son Pradeep Nair.
However, the sub-registrar refused to register the deed, which led the siblings to approach the court for resolution.
Civil Judge Nishant Bangar ruled that the sub-registrar had no legal grounds to object to the registration and ordered the immediate processing of the release deed. The judge emphasized that the sub-registrar must follow the court’s directive and has no authority to delay or refuse the registration.
Despite the court’s clear order, the sub-registrar failed to register the deed for over two months.
Frustrated with the lack of action, the heirs filed a second application before the court, seeking to hold the sub-registrar accountable for non-compliance.
In response, Civil Judge Bangar issued a show cause notice, demanding that the sub-registrar explain why he should not be punished for contempt of court.
The court has summoned the sub-registrar to appear on April 4, 2025, and explain why the court should not confiscate his office or send him to jail for failing to follow its order.
The sub-registrar now faces serious legal consequences if he fails to provide a satisfactory explanation.
Potential penalties include the confiscation of his office items and imprisonment, as the court strongly opposes officials who disregard judicial orders.
The judge has made it clear that he will not tolerate such non-compliance.
This case underscores the importance of adhering to court directives and the legal consequences of failing to do so, especially when it affects citizens’ rights.
The siblings, Vidya Lakshmi and Pradeep Nair, continue to seek justice and the rightful registration of their inherited land.
