Chief Justice of India Surya Kant has voiced serious concern over certain issues that have recently come to light within the Supreme Court registry. He observed that the situation suggests significant weaknesses in the Court’s internal mechanisms, which, he emphasised, cannot be overlooked.

The CJI specifically cited an instance involving a petition that had earlier been dismissed by a three-judge Bench. The same petition was later listed before another Bench without any apparent justification.

He described this development as a clear violation of established listing norms. He also termed it a matter of grave institutional concern.

Beyond procedural irregularities, CJI Surya Kant also drew attention to the conduct of certain registry officials. He noted that several officers have served in the registry for two to three decades.

According to him, some appear to operate under the impression that they are insulated from judicial supervision or administrative reform.

The Chief Justice warned that such an attitude poses a serious threat to the credibility and smooth functioning of the institution. He underscored that no individual within the system can be considered beyond scrutiny or accountability.

CJI Surya Kant further stated that failing to correct these shortcomings before the end of his tenure would amount to a dereliction of duty. He affirmed his determination to undertake firm and meaningful reforms to restore confidence in the system.

What Comes Next?

Indicating the way forward, the Chief Justice announced that a comprehensive inquiry into the registry’s functioning would be initiated.

He remarked that some officials may mistakenly believe that judges are temporary custodians while they themselves are permanent fixtures, a perception he suggested has contributed to arbitrary practices in certain cases.

His remarks underline the pressing need for administrative restructuring within the Supreme Court.

The proposed measures are widely viewed as essential to reinforcing transparency, strengthening accountability, and preserving the integrity of judicial processes.
