CJI BR Gavai Highlights Judicial Role In Strengthening International Arbitration

Chief Justice of India, Hon’ble Justice BR Gavai, inaugurated the Delhi Arbitration Weekend 3.0 on Thursday, emphasising the pivotal role of the judiciary and institutions in shaping India as a global arbitration hub.

Justice Gavai extended a warm welcome to dignitaries and practitioners from across the globe, highlighting the uniqueness of India’s judiciary-led forum for arbitration.

“Delhi Arbitration Weekend is a rare gathering where judges invite lawyers to engage in dialogue rather than limit discussion,” he remarked.

Evolution of International Arbitration

Tracing the history of arbitration, Justice Gavai noted that dispute resolution by neutral third parties has existed across cultures, from Indian village panchayats to medieval European guilds.

Post-World War II developments, including the New York Convention (1958) and UNCITRAL Model Law (1985), established a harmonised international framework. Courts and institutions, he stressed, remain crucial to maintaining credibility, fairness, and efficiency in arbitration.

Justice Gavai highlighted India’s strides in arbitration infrastructure, legislation, and institutional development.

The Delhi International Arbitration Centre (DIAC), established in 2009, has grown into a trusted forum handling domestic and international disputes efficiently.

He also acknowledged the Arbitration Bar of India for creating task forces on ethics, construction disputes, investment treaties, diversity, and technology integration.

Judicial Support and Global Recognition

The Chief Justice noted landmark rulings, including CORE vs ECI SPIC SMO and Gayatri Balasamy, that strengthen the finality of awards and ensure fair dispute resolution.

“Judicial restraint and support boost confidence in India as a preferred arbitration seat,” he said.

International comparisons with Australia, Singapore, and the UK illustrate the benefits of judicial clarity and minimal interference.

Justice Gavai stressed improving accessibility, affordability, and efficiency, especially for MSMEs. He urged stakeholders to prioritise cooperation over confrontation, streamlining processes, reducing costs, and fostering a credible arbitration culture.

India at a Tipping Point

Concluding his address, Justice Gavai said India is at a decisive tipping point, emerging as a preferred global arbitration hub.

Recent international arbitration events increasingly feature India-focused panels, and the White & Case–QMUL survey recognises New Delhi as an emerging seat alongside London, Singapore, and Geneva.

“The Delhi Arbitration Weekend is more than a conference; it is a forum for dialogue, trust-building, and shaping a credible arbitration culture. With vision, humility, and persistence, India is poised to contribute meaningfully to the global arbitration discourse,” he said.

Justice Gavai also expressed gratitude to the Hon’ble Chief Justice and judges of the Delhi High Court, as well as the organising committee, for their efforts in making the event a grand success.
