The Constitution Bench of the Supreme Court on Tuesday has unanimously dismissed the review petition filed against its previous decision regarding Article 370.
The Bench stated that there was no error in its earlier ruling on 11 December 2023, which upheld the Central Government’s decision to repeal Article 370.
The petitions challenging the repeal were also dismissed by the Supreme Court on the same day.
The 5-member Constitution Bench, led by the Chief Justice of India, affirmed that Article 370 was a temporary provision and that the President had the authority to revoke it.
Additionally, the Supreme Court directed the restoration of Jammu and Kashmir’s state status and mandated the Election Commission to conduct assembly elections in the region by 30 September 2024.
The Bench emphasized that Jammu and Kashmir is an integral part of India and does not possess sovereignty after its accession to the country. Therefore, special provisions cannot be retained for it.
Regarding challenges to the Central Government’s decisions, the Chief Justice of India remarked that not every decision can be contested to prevent disorder.
