The Supreme Court has rejected a review petition challenging its system of providing a quota within the quota for Scheduled Castes (SC) and Scheduled Tribes (ST). The court’s Constitution Bench approved this reservation, emphasizing the importance of identifying and excluding the creamy layer within these categories.
Major Decision by Constitution Bench
The Constitution Bench, led by Chief Justice DY Chandrachud, reached its decision with a 6-1 majority. The bench stated that Scheduled Castes are not a homogeneous group, allowing the government to sub-classify them to prioritize those who suffer most. This ruling overturned a 2004 Supreme Court decision in the Chinnaiya case, which had opposed sub-classification for SCs and STs. The court affirmed that states have the authority to create quotas within quotas, enabling the most needy to receive priority in reservations.
Clarification on Creamy Layer Controversy
The Supreme Court noted that all categories should be appropriately defined, asserting that this approach does not violate Article 341 of the Constitution. It also raised the issue of the creamy layer, questioning the resistance to applying it to SC/ST groups. The court’s decision prompts questions about the implications of including the creamy layer in SC/ST reservations and its potential impact on equitable distribution within these communities.
