The Supreme Court has issued a temporary halt to a previous order permitting the termination of a 26-week pregnancy. This decision was made after the government submitted a medical report indicating that the fetus is “viable” and has a strong chance of survival. The court, in response to a government request, expressed the need to hear from the woman involved before making a new decision.

Allowed the termination

The court that initially allowed the termination expressed frustration with a last-minute AIIMS report and questioned why it wasn’t presented earlier. Justice Hima Kohli emphasized that the court does not want to prevent the termination of a pregnancy with a heartbeat.

Previous occasion

On a previous occasion, a different bench of the Supreme Court had allowed a couple to proceed with the abortion of their 26-week-old pregnancy. The petitioner’s argument centered around the woman’s health issues and postnatal depression.

The woman stated that she is not financially, emotionally, or socially capable of raising a third child, especially while she is already breastfeeding her second child. The hearing is set to continue at 2 pm.
