Report Finds 33% of Rajya Sabha MPs Have Declared Criminal Cases

A recent analysis conducted by the Association for Democratic Reforms (ADR) and National Election Watch (NEW) sheds light on concerning trends within the Rajya Sabha, the upper house of India’s Parliament. The findings reveal a significant presence of criminal cases among sitting members, alongside vast disparities in wealth distribution across different political parties.

According to the analysis, out of the 225 Rajya Sabha sitting members examined, a staggering 33 per cent have declared criminal cases against themselves. These cases range from serious offences like murder and attempted murder to other criminal charges. Notably, two members have declared cases related to murder under IPC Section 302, and four members have cases related to attempted murder under IPC Section 307.

Furthermore, 18 per cent of the Rajya Sabha sitting members have declared serious criminal cases against themselves, adding to the gravity of the situation. This alarming revelation raises questions about the integrity and suitability of lawmakers holding such positions of authority.

The distribution of these criminal cases across different political parties paints a concerning picture. The Bharatiya Janata Party (BJP) leads with 23 per cent of its members facing criminal charges, followed closely by the Indian National Congress with 50 per cent of its members similarly embroiled in legal issues. Other parties like the Trinamool Congress (TMC), Rashtriya Janata Dal (RJD), Communist Party of India (Marxist) (CPI(M)), Aam Aadmi Party (AAP), Yuvajana Sramika Rythu Congress Party (YSRCP), and Dravida Munnetra Kazhagam (DMK) also have notable percentages of members with criminal cases against them.

Delving into the asset holdings of Rajya Sabha members reveals another concerning aspect of the analysis. The average assets per member stand at an astonishing ₹87.12 crore. Significant wealth disparities exist across different political parties, with some members possessing assets valued at more than ₹100 crore.

Among the major parties, the analysis highlights the Bharatiya Janata Party (BJP), Indian National Congress, Yuvajana Sramika Rythu Congress Party (YSRCP), Aam Aadmi Party (AAP), Telangana Rashtra Samithi (TRS), Rashtriya Janata Dal (RJD), and others. These parties exhibit varying levels of wealth among their members, with some surpassing the ₹100 crore mark in average assets per member.

The total assets of the analyzed Rajya Sabha sitting members amount to a staggering ₹19,602 crore, underscoring the immense wealth wielded by these lawmakers.

Overall, the findings of this analysis raise serious concerns about the nexus between criminality and political power, as well as the concentration of wealth among elected representatives. It calls for greater transparency, accountability, and scrutiny within India’s parliamentary system to uphold the principles of democracy and the rule of law.
