Rahul Gandhi Moves Supreme Court Against CBI, ED Verification Orders In Assets Case

Leader of the Opposition in the Lok Sabha Rahul Gandhi has approached the Supreme Court challenging Allahabad High Court orders directing the CBI and Enforcement Directorate (ED) to verify allegations that he possesses assets disproportionate to his known sources of income.

A Bench headed by Chief Justice Surya Kant is scheduled to hear Gandhi’s petition on August 17. He has challenged orders passed in connection with a complaint filed by Vignesh Shishir, a BJP worker from Karnataka, who alleged that Gandhi held disproportionate assets.

In May, the Allahabad High Court said that if the concerned agencies had received the complaint, they should verify the allegations in accordance with the law.

The court also allowed the CBI and ED to take appropriate action if warranted.

During a hearing on July 20, the High Court expressed dissatisfaction with a CBI affidavit, saying it did not adequately comply with its earlier directions.

The court, however, noted the steps taken by the ED and said the agency could proceed according to law if its verification or investigation produced actionable information.

The High Court also directed the Department of Personnel and Training (DoPT), the Revenue Department, the Ministry of Finance, the Ministry of Corporate Affairs and the Director of the Serious Fraud Investigation Office to respond to the allegations.

Along with challenging the High Court’s directions, Gandhi has filed a separate transfer petition in the Supreme Court seeking to move the proceedings from the Allahabad High Court to the Delhi High Court.

The Allahabad High Court will hear the matter on August 20.

Gandhi’s move to the Supreme Court comes as the allegations continue to undergo scrutiny by the concerned agencies and courts.
