J&K Reservation And Reorganisation Amendment Bill Passed By Parliament
Jammu and Kashmir (J&K) Reservation (Amendment) Bill, 2023 and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023 were unanimously approved by the Rajya Sabha on Monday, during the ongoing Winter Session of Parliament, by a voice vote.
Bills to give “rights to those who faced injustice”
The proposals’ main goal is to give “rights to those who faced injustice” by amending important Union Territory laws. Both acts were enacted in the face of opposition leaders calling for the former state to be given back its independence and holding elections there. Both legislation were approved by the Lok Sabha last week.
In order to give “rights to those who faced injustice” and were denied of their rights in the Union Territory, the Jammu and Kashmir Reservation (Amendment) Bill, 2023 and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023 were written. A few hours after the Supreme Court ruled that the Executive Order nullifying Article 370 of the Constitution and removing Jammu and Kashmir’s statehood was constitutionally lawful, the Bills were jointly considered.

The 2023 J&K Reservation (Amendment) Bill
The Jammu and Kashmir Reservation Act, 2004 is intended to be amended by the Jammu and Kashmir Reservation (Amendment) Bill, 2023. The Jammu and Kashmir Reservation Act of 2004 gave Scheduled Castes (SCs), Scheduled Tribes (STs), and other socially and educationally disadvantaged groups preference for employment and admittance to professional institutions.
The 2023 J&K Reorganization (Amendment) Bill
The Jammu and Kashmir Reorganisation (Amendment) Bill, 2023 aims to alter the 2019 Act and give Kashmiri migrants and displaced people from the PoK representation in the Legislative Assembly. It aims to designate one representative of the displaced people from Pakistan-occupied Kashmir (PoK) and two members of the Kashmiri migrant community for the Legislative Assembly. The revised measure suggests increasing the Legislative Assembly’s size from 83 to 90 seats.
With the passage of the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023, seats for members of Scheduled Castes and Scheduled Tribes will be reserved. In order for the Lieutenant Governor to nominate no more than two members—one of whom must be a woman—from the community of “Kashmiri Migrants” and one member from the group of “Displaced Persons from Pakistan occupied Jammu and Kashmir” to the Jammu and Kashmir Assembly, new sections 15A and 15B must be inserted into the Jammu and Kashmir Reorganisation Act, 2019.
