In a deeply concerning incident, a seven-year-old boy has been accused of sexually assaulting a five-year-old girl in Uttar Pradesh’s Kanpur Dehat district. The incident took place in a village within the jurisdiction of the Akbarpur police station on Sunday night, following the girl’s mother’s allegation that a boy from their neighborhood had sexually assaulted her daughter.
The mother of the five-year-old girl revealed that her daughter had gone out to play when this distressing incident occurred. Subsequently, upon the mother’s report to the police, both children were taken to the district hospital, where a medical examination confirmed the occurrence of sexual assault.
In response, the police registered an FIR under sections 376 of the Indian Penal Code (IPC) and sections 5/6 of the Protection of Children from Sexual Offences (POCSO) Act on Tuesday, based on the complaint filed by the girl’s mother.
It’s important to note that section 82 of the Indian Penal Code, 1860, under Chapter IV, explicitly states that “nothing is an offence when committed by a child under 7 years of age.” As a result, children under the age of seven cannot be held criminally responsible.
Inspector Satish Singh of the Akbarpur Kotwali police station emphasized that the police are handling this case with utmost caution. He stated, “If a child under the age of seven engages in wrongdoing, it doesn’t classify as a criminal act. However, we will consider additional steps in this particular instance after seeking legal counsel. The First Information Report (FIR) was filed on Tuesday.”
