Delhi High Court Orders Centre To Decide On Detention And Visa Extension For Foreign Nationals On Bail

The government has yet to determine whether foreign nationals on bail should be placed in detention centres or whether their visas should be extended for trial purposes

The Delhi High Court has directed the Central government to decide by December 16 whether foreigners accused of crimes and released on bail should be kept in detention centres. The court also asked if their visas should be extended to allow them to face trial in India.

The court’s direction came while considering a question referred by a magistrate court. The high court noted that this issue has significant implications for how bail orders are passed for foreign nationals facing criminal charges in India.

Centre to Decide on Policy for Foreign Nationals on Bail

The Centre informed the bench that it is aware of the matter at the policy level but has not yet made a decision. The government has yet to determine whether foreign nationals on bail should be placed in detention centres or whether their visas should be extended for trial purposes.

The bench emphasized the need for a clear policy on this issue. It stated that an expeditious decision is necessary, given the potential impact on foreign nationals on bail and the judicial process.
