The Delhi High Court has granted bail to former BJP MLA Kuldeep Singh Sengar on medical grounds. Sengar is serving a 10-year sentence in the custodial death case related to the Unnao rape victim’s father. The court has suspended his sentence until the next hearing, scheduled for December 20, 2024.
Sengar Seeks Medical Bail
Justice Manoj Kumar Ohri provisionally suspended Sengar’s sentence on medical grounds. Sengar had approached the court seeking interim suspension of sentence for treatment. His lawyer, Kanhaiya Singhal, pointed out that Sengar was granted a two-week suspension earlier in the POCSO case for medical treatment. He argued that there was no suspension of sentence in the custodial death case, which hindered Sengar’s release.
Medical Bail Granted in the POCSO Case
On December 5, the High Court had granted Kuldeep Singh Sengar two weeks of interim bail for medical treatment. Sengar is serving life imprisonment in the POCSO case and was convicted in the Unnao rape case in 2018. The court ordered Sengar’s admission to AIIMS, New Delhi, for medical evaluation, as he suffers from several health issues, including diabetes, cataract, and retinal problems. The court also instructed that Sengar remain under supervision and not leave Delhi during his treatment.
Senior advocate N Hariharan requested that Sengar be treated at Shankar Netralaya in Chennai for his retinal issues. However, the victim’s lawyer, Mehmood Pracha, opposed the bail plea, citing concerns for the victim’s safety and stating that earlier medical reports did not show that treatment could not be provided at AIIMS.
