The Delhi High Court has granted regular bail to Krishna and Manoj Mittal, the accused in the Kanjhawala hit-and-run case. They have been in custody since January 1, 2023.

Justice Amit Mahajan made the ruling with certain conditions. He stated that it cannot yet be proved that the accused intended to cause the accident that killed the victim. The court will determine if there was a criminal conspiracy during the lower court trial.

Justice Mahajan recognized the seriousness of the crime but noted that the evidence so far does not show premeditation by the accused. He suggested that the accused might face charges under Section 120B of the IPC, which deals with criminal conspiracy.

The court emphasized that jail aims to ensure the accused attend their trial, not to punish or prevent them. Given that the charge sheet has been filed and no immediate trial is expected, the court decided to release the accused on bail. The release comes with conditions to prevent tampering with evidence or avoiding the trial.
