Delhi HC upheld the police’s ruling and denied permission to establish Muslim Mahapanchayat in Ramlila Maidan

In light of the continuous conflict between Israel and Hamas, pro-opposition shouts are being raised by people in many nations, and mutual tranquility is eroding. On October 29, the Delhi Police was criticised by the High Court for refusing to provide permission for the All India Muslim Mahapanchayat to be held at Ramlila Maidan. The hierarchy has been upheld. The police had revoked the prior license to organise the  Mahapanchayat because they were afraid it would be a communal gathering. The annulment cannot be deemed arbitrary, the court ruled. Declaring as much, the Judge denied the organisation Mission Save Constitution’s request for authorization to convene a Mahapanchayat at Ramlila Maidan.

Mahmood Pracha, an advocate, started this organisation. He asserts that this group educates the general public—particularly Dalits—about their constitutional rights. In dismissing the organization’s appeal, Justice Subramaniam Prasad noted that the Hindus consider the period from Pitru Paksha to Diwali to be extremely auspicious. However, the organization’s poster suggests that this program would include overtly religious and communal themes. He cannot be permitted to deliver Mahapanchayat on October 29 under these circumstances. due to the fact that a lot of festivals are observed throughout that period.

The justice also said that the holding of the event could disturb communal harmony in the Old Delhi area due to the communal color of the poster. There have been communal tensions in that area before also. In this situation, the possibility of rioting by the SHO of the area cannot be ruled out. Although everyone has the freedom to express their views, the possibility of communal tension cannot be ignored.
However, the court said that after the festive season is over, the organization can apply to organize its program. The police can also consider this afresh. Provided that the organization provides the list of speakers and gives an undertaking that the program will not create any communal tension.
