Court Grants Bail To Accused In Case Linked To Delhi Riots, Notes ‘Material Change’ in Circumstances

In a case related to the 2020 northeast Delhi riots, an accused has been granted bail by a court, citing a “material change” in circumstances since the rejection of his previous bail application. The charge sheet in the case has been filed, and two co-accused have already been granted bail.

The bail application of the accused, Phool Babu, was heard by Additional Sessions Judge Pulastya Pramachala. The case against Phool Babu was registered at the Shastri Park police station.

The court took note that the accused’s previous bail application had been rejected on June 16, with reasons including the investigation being in its initial stages and the potential adverse impact on the probe if he were to be released. However, the judge opined that the filing of the charge sheet was a “material change,” and there was no reason to assume that the accused could influence the remaining reports to be received by the investigating officer (IO).

The IO informed the court that he was still awaiting the forensic report, Call Detail Record (CDR), and an injury report.

The court also considered the fact that two other accused in the same case were already out on bail, and it created a ground for parity. Taking all these factors into account, the court granted bail to the applicant or accused Phool Babu. To secure his release, he is required to furnish a personal bond and surety bond of Rs 10,000 each, with one surety of the same amount.

The bail conditions mention that the accused cannot leave the country, has to provide his mobile phone number to the court, and update the court of any change in address or personal details. Moreover, the accused must not attempt to influence any witnesses in the case. The bail order was passed on Monday.
