The co-owners of the basement involved in the Old Rajendra Nagar coaching centre accident in Delhi have approached the Delhi High Court. They filed a petition challenging the Rouse Avenue Court’s decision to reject their bail plea. The lower court had denied bail on August 23, stating that the investigation was still in its initial stages.
CBI’s Opposition and Legal Arguments
The CBI opposed the bail plea, arguing that the basement was constructed illegally and lacked proper permissions. The agency noted that the lease deed prohibited the building’s use for commercial activities, yet a poster outside the basement advertised it as a store and examination hall.
The co-owners’ lawyer argued that the death of the three students was an act of God and could have been prevented if the Municipal Corporation had fulfilled its duties. He claimed that the basement was initially a waiting area, not a library. The lawyer also mentioned that the fire department had recently inspected the premises and deemed it safe for educational use. He contended that applying culpable homicide charges required both knowledge of the case and intent to commit the crime.
Court Transfers Case and Previous Bail Rulings
The Delhi High Court transferred the case to the CBI. Previously, the Tis Hazari Court had allowed the withdrawal of bail pleas for the four accused: Tejinder Singh, Parvinder Singh, Harvinder Singh, and Sarabjit Singh. The Rouse Avenue Court had also rejected their bail petitions.
